You must be 13 years of age or older at time of entry to be eligible for this contest. This contest is void where prohibited by law.
Winners will be notified by email. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternate winner will be selected. If UPICKEM or its affiliates cannot find an eligible winner for the prize, that prize will not be awarded.
Odds of winning depend on the number of eligible entries received.
UPICKEM and its affiliates reserve the right to substitute any prize with another prize of equal or greater value.
Affiliates reserve the right to restrict the local winners to only persons whose primary residence is within a 60 mile radius of the affiliate's' office.
Employees of UPICKEM and its affiliates, their respective parents, affiliates, subsidiaries, advertising sponsors and promotional agencies, and the immediate family members of each are not eligible.
Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.
Entrants further grant to UPICKEM and its affiliates the right to use and publish their proper name and state online and in print, or any other media, in connection with the Contest.
UPICKEM and its affiliates reserve the right to use any and all information related to the Contest, including information on contestants obtained through the contest, for marketing purposes or any other purpose, unless prohibited by law.
The Contest and all of the related pages, contents and code are copyright, UPICKEM, Inc., and/or its affiliates. Copying or unauthorized use of any copyrighted materials, trademarks or any other intellectual property without the express written consent of its owner is strictly prohibited.
Each winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
UPICKEM and its affiliates are not responsible for Internet crashes or slowdowns caused by network congestion, viruses, sabotage, satellite failures, phone line failures, electrical outages, natural disasters or acts of man or God.
If a race is canceled, forfeited, or indefinitely suspended for any reason that race shall not count for any contestant and scores will be computed as if the race did not exist.
All results posted are unofficial until winners respond to e-mail notification.
Each winner is responsible for all federal, state and local taxes and will be required to complete an IRS form W-9. Sponsor reserves the right to withhold prizes until completed form W-9 is received.
For each race, players will pick the 10 drivers they think will finish 1st through 10th. Drivers will be awarded Fantasy Points depending on how they finish. 1st place is worth 150, 2nd place is worth 125, 3rd place is worth 100, 4th place is worth 80, 5th place is worth 78, and so on (less 2 points each place). 44th place and beyond are worth 0 points. The total Fantasy Points for all the player's drivers in the race becomes the Team Score. There is an additional 25 point bonus for every driver that comes in the exact order the player picks them to finish.
You total score is the sum of your 15 best races.
If there is a tie for the most points for a race, the tie breaker is handled by first seeing who picked the most drivers in the right order. If there is still a tie, the computer will see who picked the highest place correct. If there is still a tie, the computer will randomly select a winner from the players that are tied.
If there are ties for overall score, the computer will select the player with the most race points for the most recent race. If there is a tie, the computer will continue comparing race points for previous races until a winner is selected. If the players are tied for all the races, the computer wil randomly select a winner from the players that are tied.
Points are awarded to drivers, not cars. If a player picks a driver who qualified for race and a new driver took his/her place before the start of the race, the player must pick the new driver. Players will not receive points even though the new driver may be racing the previous driver's car. And, if the new driver is not in the list of drivers that can be picked then no players shall have the ability to pick that driver and it will not count for or against anyone.
Weekly winners are based on the race finish order immediately following the race. If the race finish order is adjusted after the race, the weekly winners will remain the same but all players' points will be recomputed for the season total.
All decisions of the judges are final.
This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.

SAGA COMMUNICATIONS, INC. GENERAL CONTEST RULES
Wherever the words FM99/WNOR appear in these rules, they include the business entity to which the station is licensed, and any member companies, parent corporations, and affiliates. For example, Tidewater Communications, LLC would include Saga Communications of New Hampshire, LLC, its sole member, Saga Communications of New England, LLC, and its sole member, Saga Communications, Inc.
1) No purchase is necessary to enter any FM99/WNOR contest. 2) All contestants must be permanent residents of Virginia or Northeastern North Carolina within range of the FM99 air signal and must provide FM99/WNOR with a valid form of identification and Social Security number satisfactory to FM99/WNOR management. 3) Subject to rule (4) below, all contestants must be at least 18 years old to be eligible to participate in contests that include hotel/motel accommodations, motor vehicles, boats, and/or air travel as prizes. 4) All contestants must be at least 21 years old to be eligible for all contests affiliated with an alcoholic beverage manufacturer or distributor. 5) One entry per household will be permitted to participate in a contest. A "household" is defined as any individuals residing at the same address. All individuals/households receiving a prize valued at $500.00 or more on FM99/WNOR may be issued a 1099 Federal Income Tax Form by FM99/WNOR, and are ineligible to win a prize valued at $500.00 or more for a period of one calendar year from the date of winning. If it is determined that a selected contestant is ineligible as a result of one or both of these restrictions, another contestant will be selected. This selection procedure will continue until these restrictions are satisfied. 6) Anytime the FM99/WNOR on-air studio is called, it is assumed by the caller that the phone call is being recorded and may be broadcast. The caller grants permission to FM99/WNOR to broadcast the call or record the call for later broadcast. 6a) For telephone contests, listeners may enter by calling (757-366-9999). If any problems are discovered by FM99/WNOR, different call-in numbers or addresses may be substituted and utilized after those numbers and addresses are broadcast on FM99/WNOR. In the event a caller is disconnected during a contest before his/her name and phone number is recorded, then the prize will be awarded to the next caller whose name and phone number are recorded. The person operating the telephone at FM99/WNOR has the final decision as to who is the winning caller. 7) For contests requiring written entry forms, they may be faxed to (757-366-0022), e-mailed to a contest specific address on (www.fm99.com), or mailed/delivered to FM99/WNOR – (870 Greenbrier Circle, Suite 399, Chesapeake, VA 23320). All entries become property of FM99/WNOR and will not be returned. FM99/WNOR reserves the right to retain any or all contest materials for any reason that FM99/WNOR deems necessary to the completion of the contest, or reasons relating to publicity and/or advertising. FM99/WNOR shall have no responsibility for a contestant’s failure to win or claim any prize based on difficulties with telephone, facsimile, email, or internet difficulties, or any circumstances in any contest. 8) Any specific rules and/or restrictions pertaining to individual contests (entry dates, a limit on number or words on an entry, etc.) will be disclosed in on-air announcements. 9) Prizes must be picked up by the winners at the FM99/WNOR business office or other pre-arranged or pre-announced location within thirty (30) days of notification to the winner, unless there is a deadline date by which the prizes must be picked up, in which case, that date will be specifically stated. Otherwise, failure to pick up the prizes by the deadline will result in the forfeiture of the prize, which shall remain the property of FM99/WNOR. FM99/WNOR assumes no liability for the delivery of prizes. If a winner claims a prize over $500 in value, he or she is ineligible to win any other prize from FM99/WNOR for (30) days. If a winner claims a prize over $1000, he or she is ineligible to win any other prize from FM99/WNOR for (365) days. 10) In the event the winner is subject to, or the subject of, any order or legal process issued by any governmental agency having jurisdiction over the affairs of the winner (i.e. garnishment, child support order, judgment, lien, and the like), FM99/WNOR's delivery of the prize to the official representative of the governmental entity claiming a right to the prize shall be thus deemed as FM99/WNOR awarding the prize to the winner. FM99/WNOR shall be entitled to rely in good faith, upon any documents presented by the representative seeking to collect the prize in lieu of the winner. FM99/WNOR shall not be liable for any claim by any winner for damages incidental thereto. 11) As a condition of entering a contest, contestants must agree that upon winning, they will consent to the use of their name, likeness, and all verbal and written communications with FM99/WNOR for publicity purposes. 12) Employees of FM99/WNOR (Tidewater Communications, Inc.), (and its ultimate parent company, Saga Communications, Inc.), their advertising agencies, affiliates, contest sponsors, employees and immediate families of each, and employees of all media of mass communication within a one hundred mile radius of the (station name) main studio are not eligible to win any contest. Immediate family includes the spouse, great-grandparents, grandparents, parents, brothers, sisters, children, grandchildren, and great-grandchildren of the employee and his/her spouse. This also includes individuals for whom the employee is current legal guardian.
13) All prizes are non-transferable and are not redeemable for cash. FM99/WNOR reserves the right to substitute a prize of similar value. FM99/WNOR cannot be held responsible for unforeseen cancellations or delays of concerts/events or transportation caused by weather, promoter or performer. 14) Winners are solely responsible for all applicable local, state and federal taxes. Winner may be issued a 1099 MISC federal tax form if in one calendar year the prize value of all prizes won in contests from FM99/WNOR and/or participating co-sponsors exceeds $600.00. 15) FM99/WNOR,(TIDEWATER COMMUNICATIONS, INC.), assumes no liability for liability, damages, situations, repairs, or incidents arising from any aspect of any prize awarded in any contest. FM99/WNOR, (TIDEWATER COMMUNICATIONS, INC.), all participating co-sponsor companies and their advertising and promotional agencies, affiliates thereof, employees, and immediate families of each absolve themselves and shall be held harmless from any action or liability arising from any contest or prize awarded in any contest. As a condition of entering a contest, participants may be required, upon winning, to sign a release form and affidavit of eligibility to claim their prize. Failure to do so will result in forfeiture of the contestant’s right to claim or receive the prize. 16) The following are specifically related to E-contests and E-Mail Club promotions on (www.fm99.com):
a) All appropriate information in required fields must be filled out or contestants will be disqualified. b) To be eligible to win a prize, a contestant must reside within the listening area of FM99/WNOR, as defined within the exclusive discretion of FM99/WNOR management. c) Any problems with the internet or email are not FM99/WNOR's responsibility.
d) Contestants who attempt to register to participate on FM99/WNOR’s websites may be required to produce a printed copy of proof of registration before being allowed to participate in the contest. 17) All giveaways and contests are void where prohibited by law. All local, state and federal regulations apply. As a licensee of the FCC and a trustee of the public airwaves, FM99/WNOR reserves the right to interrupt and/or discontinue any contest or promotion (and not award the offered prize) at the discretion of FM99/WNOR management if world events, the national mood, or public safety so warrant. FM99/WNOR reserves the right to disqualify any winner if the contest rules have been violated in any way. FM99/WNOR reserves the right to amend the rules to any contest at any time. All decisions of FM99/WNOR are final.
18) Although FM99/WNOR will make reasonable efforts to conduct its contests substantially as announced or advertised, FM99/WNOR reserves the right in extraordinary situations to change or modify the rules of its contests as exigent circumstances may require. In such cases, FM99/WNOR will amend the rules for that contest and broadcast the amended rules as promptly as possible. In such case, the contest will be conducted in accordance with the amended rules. 19) A copy of these rules are available during business hours at the FM99/WNOR studios, (870 Greenbrier Circle, Suite 399, Chesapeake, VA 23320).
